Seller Terms and Conditions (UK)
These Seller Terms and Conditions (“Terms”) govern your sale of goods to Fashionphile Group, LLC and/or its UK subsidiary or agents (“FASHIONPHILE”, “we”, “us”, “our”) using our services and website. These Terms form part of, and are incorporated into, our Terms of Use found on fashionphile.com.
By submitting items to us to sell or by otherwise using our selling services, you agree to be bound by these Terms. If you do not agree, you must not submit items to us or use our selling services.
If you are using our services on behalf of a business, you confirm you have authority to bind that business, and “you” includes that business.

1. Submitting Items for Buy-Out Sale (“Buyout Items”)
Price Quotes
You may submit images and descriptions of items to request a direct buy-out sale. If acceptable, we will issue a purchase offer (“Buyout Offer”). If declined, we will notify you.
Quotes are valid for 30 days. Multiple accounts or repeated submissions of the same item within 30 days are not permitted.
If you accept the Buyout Offer, you must send the item to us for inspection.
Shipment Accessories
We ask that you only send the item quoted and relevant accessories:
Accepted accessories include:

Straps, pouches, extra links, locks keys, charms, dust bag

Original box (excellent condition), authenticity documents, gem/CITES certificates

Copy of receipt (retain the original)
Do not send:
-
Damaged boxes, shopping bags, ribbon, non-original dust bags, bag organisers
Any unwanted items sent may not be returned and may be disposed of responsibly. We shall not be liable for these items.
Assessment Payment
Once received, we will inspect your item for authenticity and condition accuracy.
a) Authentic
as-described
We pay the agreed Buyout Offer.
b) Authentic but condition differs / missing accessories
We may issue a revised offer. If rejected, we will return the item to you at your expense.
c) Not authentic
See section 2 below.
2. Authenticity Cancellation
Authenticity
You warrant that all items you submit (“Sale Items”) are authentic.
Items are not considered accepted or authentic until reviewed by us. Payment does not indicate authenticity.
If an item is found to be counterfeit or unauthentic:

You must return any payment already issued.

You must pay an Authentication Fee:

£125 for Hermès Birkin or Kelly
-
£75 for all other items
-

On receipt of payment, we will return the item to you at your expense.
If the Authentication Fee remains unpaid for 60 days, we may handle the item in accordance with the Torts (Interference with Goods) Act 1977, including selling or disposing of it after giving you notice.
We may also refuse future submissions.
Cancellations (Buyout Items)
A sale becomes final once you have accepted our offer and dispatched the item.
If you request cancellation after shipment but before payment, we may (at our discretion) agree to return the item, but:

We are not liable for delays or transit issues during return.

You remain responsible for shipping costs.
If the item is unauthentic, the process above applies.
3. Pricing, Fees Discounts
Pricing
We set pricing at our discretion based on market conditions and comparable items. Prices may change at any time.
Consignment Fees
For consigned items, we charge:

30% of sale price up to £3,000

15% of the portion above £3,000
Discounts
We may discount unsold items after 30 days.
4. Consignment Term Withdrawal

Consignment term begins when we receive your item.

Initial term: 90 days, then continues until sold.
If you request early return during the initial term:

£125 fee for Hermès Birkin/Kelly
-
£75 fee for other items
-
Item returned at your cost
If the fee remains unpaid for 60 days, we may act per the Torts (Interference with Goods) Act 1977.
5. Payments
You must maintain valid payment details. By providing them you confirm you are authorised to use the payment method.
Payments are issued after:

Buyer’s return period expires (for consignment)
-
Buyer payment clears
-
Item is inspected and accepted (for buyout)
Payment options include:

UK bank transfer
- PayPal
All values are stated in GBP unless otherwise noted. If USD is used, you are responsible for conversion and bank fees.
6. Risk Insurance
Risk in your item remains with you until we receive it. We recommend you insure shipments.
7. Modifications
We may amend these Terms at any time. Continued use constitutes acceptance.
8. Breach
If you breach these Terms, we may suspend your account, refuse future submissions, or recover costs incurred.
9. Governing Law
These Terms are governed by the laws of England and Wales.
Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in these Terms affects your statutory rights under UK consumer law.
